About these terms

Nüwa helps you log meals, track habits, and understand nutritional estimates. These Terms form the agreement between you and Octal Codes for use of the app, without reducing any consumer rights granted by Brazilian law.

Accepting the terms

You accept these Terms when you create an account, access, or use Nüwa. If you do not agree, do not use the service. Nüwa is available to people who meet the age requirements below and can enter into this agreement themselves or with authorization from a legal guardian.

Age and permission

You must be at least 13 years old to create an account or use Nüwa. If you are under 18, you may use the service only with the authorization and supervision of a parent or legal guardian, who must be aware of and accept these Terms.

Do not create an account for anyone under 13. We may request proof of age or guardian authorization and may suspend or delete accounts that do not meet these requirements, subject to applicable legal obligations.

What the service offers

Nüwa is a nutrition and wellbeing app. You can describe what you ate by text, voice, or photo. OpenAI models help estimate calories and macronutrients and compare those values against targets calculated from your profile.

Your profile may include your name, age, height, weight, sex, activity level, objective, dietary restrictions, allergies, and wake and sleep times. The service also offers meal logging and planning, hydration and weight tracking, a weekly review, and remembered dishes.

Photos are processed to produce the estimate and then discarded; Nüwa does not store them. Meals, weights, and profile data are stored as described in the Privacy Policy. Features, results, and availability may vary by device, language, region, and app version.

Account access and security

Accounts use an email address and password. Provide accurate, current information, keep your credentials secure, and do not share access. You are responsible for activity on your account unless the law provides otherwise.

Tell us if you suspect unauthorized access. You may request account deletion in the app or at nuwafit.com/delete-account. Deletion follows the Privacy Policy and may not cover information that must be retained for legal obligations, security, fraud prevention, or the protection of rights.

Plans, billing, and cancellation

The free tier includes up to 3 AI calls per day and 7 days of history. Nüwa Pro is offered as monthly and annual subscriptions. It removes the daily AI limit, opens full history, and unlocks Pro features, including carbohydrate and fat targets, always subject to the acceptable-use rules.

Purchases are processed by the Apple App Store or Google Play, not directly by Nüwa. RevenueCat helps manage subscription status, but prices, taxes, billing, automatic renewal, cancellation, and refunds are governed by the terms and policies of the store where you purchased. Your subscription renews automatically until you cancel it before the next renewal.

Deleting the app or your account does not automatically cancel a store subscription. If Pro ends, your account returns to the free-tier limits. Your existing data is not deleted merely because Pro ended; access to history is limited to 7 days until Pro is reactivated, without affecting any deletion request you make.

Acceptable use

You may not:

• Scrape, bulk-copy, resell, or commercially exploit the service without authorization.
• Reverse engineer, bypass protections, or attempt to access code, systems, or data without permission, except where the law expressly allows it.
• Automate calls, create artificial load, or abuse AI features, including on plans without a daily limit.
• Submit illegal, malicious, deceptive content or content that infringes third-party rights.
• Upload photos, audio, or other materials that you do not have the right to use.
• Use Nüwa to harm people, interfere with the service, or violate applicable law.

Your content

You keep your rights in text, records, photos, and other content you submit. You grant us a limited, non-exclusive, worldwide, royalty-free license only to host, transmit, process, technically reproduce, and display that content as necessary to operate, protect, and provide Nüwa to you.

This license does not authorize us to use your content for advertising or to train third-party models. We do not sell your data. Meal photos are used only for the requested analysis and then discarded, as described in the Privacy Policy. The license ends when the content or account is deleted, except for the time technically needed to complete deletion or where retention is legally required.

Intellectual property

Nüwa, its software, interface, visual identity, brand, original text, and other service elements are protected by intellectual property rights owned by Octal Codes and its licensors. These Terms allow personal, limited, revocable, non-exclusive, non-transferable use of the app; they do not transfer to you any right in Nüwa's brand, code, or content.

Availability and suspension

We may fix, update, add, limit, or remove features, including plan limits, when needed for security, performance, service sustainability, or legal compliance. When a change materially affects an active subscription, we will respect applicable rights and notify you when required.

Interruptions may occur because of maintenance, third-party failures, events beyond our control, or security reasons. We may restrict or suspend an account that violates these Terms, puts the service or others at risk, or creates a legal obligation. Where appropriate, we will give notice and an opportunity to correct the issue.

Warranties and liability

Nüwa is provided as available. Although we work to keep the service safe and useful, we do not guarantee uninterrupted operation, compatibility with every device, absolute accuracy of estimates, or any particular health, weight, or performance outcome.

Nothing in these Terms excludes or limits mandatory rights under Brazil's Consumer Protection Code or any other applicable law. Octal Codes will be responsible in the cases and to the extent established by Brazilian law. Any exclusion or limitation described in these Terms applies only where and to the extent permitted by law.

Changes to these terms

We may update these Terms when the service, plans, providers, or laws change. The date at the top identifies the current version. When a change is material, we will notify you through the app, by email, or through another reasonable channel before it takes effect when required by law. If you do not agree with the new version, you may stop using the service and cancel your subscription.

Law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. Any dispute will be submitted to the legally competent Brazilian courts, including the courts of the consumer's domicile where that protection applies. Before starting a claim, you may contact us so we can try to resolve the issue directly.
